Depositor protection at banks and securities dealersIn the event of a bank or securities dealer being declared bankrupt, deposits of up to a maximum of 100,000 Swiss francs per client are regarded as preferential deposits. This applies to all client deposits, including those booked at branches of banks or securities dealers outside Switzerland.
Provided the bank or securities dealer has sufficient liquidity, preferential deposits of up to 100,000 Swiss francs held at branches in or outside Switzerland will be paid out immediately without any offsetting of claims and outside the ordinary schedule of claims.
Only in cases where preferential deposits cannot be paid out immediately, does the Deposit Protection Scheme step in for privileged deposits booked in Switzerland. Under this scheme, depositors are guaranteed payment of deposits by way of an advance; the amount is made available to pay out within 20 working days following FINMA’s request to do so. Where payments are made under the Deposit Protection Scheme, preferential claims are assigned to the scheme.
Deposits at bank foundations and vested benefits foundations are treated separately and additionally to other deposits, up to a maximum of 100,000 Swiss francs privileged. They do not, however, benefit from additional cover under the Deposit Protection Scheme, and there is no immediate pay-out outside the ordinary schedule of claims.
Where client deposits cannot be paid out in advance as preferential deposits, they will be settled by way of a liquidation dividend during the bankruptcy proceedings.
Unlike cash deposits in bank accounts, assets in custodial accounts are client property (i.e. shares, units in collective investment schemes and other securities). In the event a bank or securities dealer goes bankrupt, all such assets are immediately ring-fenced, excluded from bankruptcy and then released to clients.
